Yes — the GDPR can apply to Mailpro customers based outside the European Union, depending on who you send to. Our contractual setup is designed so non-EU companies remain compliant when they email or text EU residents.
When GDPR follows you, even outside the EU
The GDPR applies extraterritorially. If you offer goods or services to EU residents, or monitor their behaviour, the regulation governs your processing of their personal data — regardless of where your company is registered. Sending email or SMS campaigns to EU recipients is a typical trigger.
How Mailpro keeps you compliant
- Servers and data center in Switzerland with GDPR-aligned safeguards (see data security)
- Right to access, rectify, port, and erase personal data
- Detailed retention rules for stats, bounces, and account data
- Audit logs for every account action
- No resale of customer data to third parties
Which Maxony entity is your contract with?
If your country of residence is in the European Union, your contract is with MAXONY Schweiz SA, a Swiss company at Rue Agasse 54, 1208 Geneva. If your country of residence is outside the EU, your contract is with Maxony Inc., a Panamanian company. The dual setup keeps cross-border tax, billing, and data-protection obligations clean for every customer.
Governing law and jurisdiction
The relationship between Mailpro and the customer is governed by Swiss law. In the event of a dispute, the competent court is in Geneva, Switzerland. Our Terms are translated into several languages for convenience — if there is any discrepancy, the French version prevails.
