Short answer: yes. Sending marketing emails and newsletters is legal in Barbados. No licence is needed and no law bans bulk email. What the law regulates is how you use people’s personal data. Since 31 March 2021, that has meant the Data Protection Act, 2019–29, overseen by the Data Protection Commissioner. This page covers the questions Barbadian businesses ask most often. It is general information, not legal advice.

Is there a Barbados anti-spam law?

Not as a separate statute. Unlike the United States (CAN-SPAM), Canada (CASL) or Australia (Spam Act 2003), Barbados has no dedicated anti-spam act. The Data Protection Act fills the gap. Every marketing email is sent to an identifiable person, so the Act’s rules on lawful processing, transparency and the right to object all apply. The practical result is close to a consent-based regime.

What makes a campaign lawful in Barbados?

RequirementWhat it means in practice
A lawful basisUsually consent: a freely given, specific, informed and unambiguous yes, given by a statement or a clear action such as ticking an empty box.
TransparencyTell subscribers who you are, what you will send, why, and how long you keep their data.
A way to stopThe Act lets anyone require you, by written notice, to stop using their data for direct marketing, at the latest after 21 days. An unsubscribe link makes this immediate.
Accuracy and minimisationCollect only what you need; clean bounced and outdated addresses.
SecurityProtect the list against loss or unauthorised access, and report breaches to the Commissioner, where feasible within 72 hours.
Safe transfersIf your email platform stores data outside Barbados, the destination must offer adequate protection or appropriate safeguards.

What happens if you get it wrong?

The Barbados Act uses criminal offences. Breaching the core data protection principles, or transferring personal data abroad without adequate protection, can bring a fine of BBD $500,000 on summary conviction (about US$250,000 at the fixed 2:1 exchange rate), up to three years in prison, or both. Individuals can also complain to the Commissioner or apply to the High Court. For a hotel or financial-services firm, the damage to reputation can matter as much as the fine. Guests and clients expect their details to be handled carefully.

Do European or North American rules apply to a Barbadian company?

Not to your Barbadian contacts. But many Barbadian businesses market to people abroad: villa owners with British guests, attractions promoting to North American cruise and stay-over visitors, or firms that relocated staff under the Welcome Stamp remote-work programme. When you target people in the EU or the UK, their local rules can apply to those contacts. The same goes for Canada’s CASL and the US CAN-SPAM Act. Mailpro’s guide to GDPR for companies outside Europe explains when that happens. The general emailing rules page summarises good practice across markets.

What about SMS marketing?

The Act’s definition of direct marketing covers communication “by whatever means”, so texts to +1-246 mobile numbers follow the same principles as email: consent, identification and an easy opt-out. See the SMS laws and restrictions overview and our SMS marketing in Barbados page.

Five habits that keep Barbadian campaigns on the right side of the law

  1. Collect addresses only through forms with an empty consent box, and consider double opt-in to prove it.
  2. Never use a purchased or scraped list; here is why.
  3. Identify your business clearly and include a working unsubscribe link in every message.
  4. Process “stop” requests at once rather than waiting the full 21 days the Act allows.
  5. Choose a provider whose hosting you can justify under the transfer rules. Mailpro stores data in Switzerland, on private infrastructure outside US jurisdiction, in a country with an EU adequacy decision.
