The LGPD (Lei Geral de Proteção de Dados) is Brazil's general data protection law, in force since 2020. Modeled closely on the EU's GDPR, it regulates how organizations collect, use and store the personal data of people in Brazil, and grants data subjects rights such as access, correction and deletion.
How the LGPD works
The LGPD requires a valid legal basis for processing personal data — consent is the most common for marketing — and obliges organizations to be transparent, to honor data-subject requests, and to report certain breaches. It applies to any organization processing data of individuals in Brazil, regardless of where the organization is based, and is enforced by the national authority (ANPD), which can issue fines.
